1. About these Terms
These Terms of Use govern your access to and use of Aimee Says, an AI platform for survivors of relationship abuse provided by Aimee Says Inc., a Delaware corporation ("Aimee Says," "we," "us"). By creating an account or otherwise accessing the service, you agree to be bound by these Terms. If you do not agree, do not use the service.
We may update these Terms from time to time. Material changes will be highlighted on the site and emailed to registered users. Continued use after a change indicates your acceptance of the change.
2. Eligibility
You must be at least 18 years old to create an account or use Aimee Says. The service is not directed to anyone under 18, and we do not knowingly collect information from anyone under that age. If you are a parent or guardian and believe a minor has provided us with information, please email support@aimeesays.com.
3. AI disclaimers
3.1 Not a therapist or medical professional
Aimee is not a licensed therapist, psychologist, counselor, or medical professional. Aimee does not diagnose, treat, or prescribe.
3.2 Not an attorney
Aimee is not a licensed attorney and does not provide legal advice. Any legal information should be independently verified with qualified counsel before you act on it.
3.3 May be inaccurate
Aimee's responses may be inaccurate, incomplete, or out of date. You are responsible for independently verifying any claim before acting on it.
3.4 Not automatically privileged
Communications with Aimee are not automatically protected by attorney-client, therapist-patient, or any other legal privilege. Depending on the circumstances, these communications may be discoverable in legal proceedings. For more information about legal discovery, contact support@aimeesays.com.
3.5 Not appropriate for emergencies
Aimee is not designed for emergencies. If you or someone else is in immediate danger, contact local emergency services.
3.6 You are responsible for your decisions
You are solely responsible for decisions you make based on Aimee's output. Aimee Says Inc. is not liable for any real-world consequences of those decisions.
4. No AI training on your content
We do not train any Aimee Says model on your content, and our agreement with our AI provider prohibits it from doing so.
5. Account tiers
Aimee Says is offered in three tiers:
· Anonymous. No account is required to start a single chat session. Anonymous chat session data is deleted from Aimee Says within 24 hours. Our AI provider may keep encrypted copies of anonymous conversations for automated safety review, as described in Section 9.4 of the Privacy Policy.
· Free (registered). Sign up with an email address or Google account. Data is stored while the account is active. A free account that has been inactive for 365 consecutive days will be deleted after 14 days of advance email notice.
· Paid. Billed through Stripe, beginning with a 7-day free trial. Data is stored while the subscription is active. After cancellation, account closure, or lapse of the subscription (including following a failed-payment grace period), an account that has been inactive for 365 consecutive days will be deleted after 14 days of advance email notice.
6. Display names and billing names
Your display name on Aimee Says may be a pseudonym. For paid accounts, the cardholder name and billing address are collected and held by Stripe; Aimee Says receives this information from Stripe for billing and tax purposes. See the Privacy Policy for details on what we hold versus what Stripe holds.
7. Multiple accounts and credential sharing
You may hold more than one account. Sharing account credentials commingles data and is discouraged; the account holder is responsible for all activity on their account.
8. Multi-factor authentication
Multi-factor authentication is available on all accounts and is strongly recommended.
9. Acceptable use
You agree not to use Aimee Says to:
· harass, threaten, dox, or intimidate any person, including a person you describe as an abuser;
· upload or share any image or video that depicts the sexual abuse or sexual exploitation of a minor, or generate or request content that sexualizes minors in any way. This applies even if the material is evidence of abuse you are trying to document (see "Documenting abuse of a child" below). Uploaded images are automatically scanned for child sexual abuse material, and images flagged by that scan are kept by our AI provider for review and, where the law requires, reported to the authorities;
· upload or share sexually explicit or intimate imagery of another person without their consent, except as permitted under "Documenting image-based abuse" below;
· impersonate another person;
· attempt to access another user's account, content, or data;
· scrape, automate access to, or circumvent rate limits, security, or other technical protections of the service;
· reverse engineer the AI, or use the service or its outputs to train, fine-tune, or evaluate any AI model; or
· use the service for any unlawful purpose.
9.1 Documentation of violence or abuse
Aimee Says recognizes that survivors of abuse may need to retain imagery that documents harm done to them or their children. You may upload non-CSAM violent imagery to your own private account for documentation purposes.
Documenting abuse of a child. Many people use Aimee Says to record harm done to their children, including sexual abuse. You are welcome to describe in writing what happened, what you saw or were told, when it happened, who was involved, and who you reported it to. Aimee Says is built to help you do this. However, never upload photos or videos that show a child being sexually abused or exploited, even to preserve evidence. Possessing or sharing that material is a crime in most places, whatever the reason. Uploaded images are scanned, and flagged images are kept for review and may be reported to authorities. If such images exist, do not copy, forward or save them. Instead, report them to law enforcement or to the NCMEC CyberTipline (report.cybertip.org or 1-800-843-5678), who can preserve them properly. You can note in Aimee Says that the material exists and when and to whom you reported it.
Documenting image-based abuse. If someone has shared, posted, or threatened to share intimate or sexually explicit images of you without your consent, you may save those images, and screenshots of where they appeared, to your own private account to document the abuse. This is allowed even if the person who shared them also appears in the images. Such images must show only adults. If you were under 18 when an image was taken, do not upload it; see "Documenting abuse of a child" above. You may not use Aimee Says to send, publish, or further distribute these images.
We make no representation that any material stored on the service will be admissible, authenticated, or otherwise legally sufficient for any proceeding; if you anticipate using a file as evidence, you remain responsible for preserving the original file and its metadata outside the service.
10. Paid subscriptions and billing
Paid subscriptions are billed in advance through Stripe. Each paid subscription begins with a 7-day free trial. You will not be charged during the trial. At the end of the trial, the subscription automatically renews each billing period until you cancel.
10.1 Auto-renewal disclosures
By starting a paid subscription you authorize Aimee Says, through Stripe, to charge your payment method on the first day after your free trial and on each subsequent billing date until you cancel. You may cancel at any time in Settings, effective at the end of the then-current billing period. These disclosures apply to all paid subscriptions, monthly and annual.
10.2 Annual subscriptions
If you sign up for an annual subscription, we will send a reminder email at least 15 and no more than 45 days before each renewal. Monthly subscriptions do not receive renewal-reminder emails because charges occur every month and are visible to you on your payment method statement.
10.3 Refunds
Except as required by law, we do not offer refunds for unused portions of a billing period. EU residents may cancel and request a refund within 14 days of the first charge under EU consumer protection law; this 14-day right does not consume your 7-day free trial, because no charge occurs during the trial.
10.4 Failed payments
If a payment fails, Stripe will attempt to retry on a standard schedule. If retries fail, the paid subscription will lapse. A lapsed subscription is treated as a cancellation, and content is then governed by the retention rules in Section 5.
11. Referrals
Aimee Says may offer incentives for referring friends. Self-referrals are not permitted. Aimee Says may reverse incentives obtained through fraud or abuse.
12. Affiliates
Affiliates must comply with FTC endorsement guidelines, including clear disclosure of the paid relationship. Affiliates may not bid on Aimee Says trademarks in paid search. Affiliate payouts apply to the first billing cycle of each new paying customer they refer.
13. Coupons
Coupons are non-transferable, limited to one per user, and may be revoked at any time.
14. Your content
You retain ownership of your chats, Events, Binders, My Story, and any documents you upload or create using the service.
To operate the service, you grant Aimee Says a limited, non-exclusive license to host, process, transmit, display back to you, securely back up, and share with our AI service providers your content, only as needed to deliver responses, perform automated safety screening, and operate the service, subject to the provider terms described in the Privacy Policy. The license ends when your content is deleted, except as needed to retain anonymized metadata as described in Section 15.
15. Anonymized metadata
The results of any analysis Aimee Says conducts are always anonymized, and can include abuse tactics, child factors, feature usage, and session length - to understand the needs of our users and to improve the service. Metadata used in this way is stripped of direct identifiers.
16. PostHog feedback consent
We may use the content of a specific feedback message you submit in our marketing, but only when you explicitly check the "Can we use your message in social media?" box in the PostHog feedback form. We will not use any other content for marketing.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL AIMEE SAYS INC., ITS LICENSORS, OR ITS SUPPLIERS BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Aimee Says Inc.'s aggregate liability arising out of or relating to these Terms or your use of the service is limited to the greater of (a) $1,000 USD and (b) the total amount you paid Aimee Says in the twelve months preceding the event giving rise to the claim. Any claim must be brought within one year of the event giving rise to it.
18. Indemnity
You agree to indemnify and hold harmless Aimee Says Inc., its officers, directors, employees, agents, licensors, and suppliers from any claims, damages, and costs (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your violation of applicable law; (c) your infringement of any third-party intellectual property right; or (d) content you upload that causes a claim against Aimee Says.
19. Arbitration and class action waiver
Please read this section carefully. It affects your legal rights.
You and Aimee Says Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or your use of the service ("Disputes") will be resolved exclusively through binding individual arbitration, rather than in court, except that either party may seek equitable relief in a court of competent jurisdiction to prevent the actual or threatened misuse, misappropriation, or infringement of intellectual property rights. Arbitration will be conducted by a single arbitrator under the American Arbitration Association's Consumer Arbitration Rules, with the seat in Denver, Colorado, unless the parties agree otherwise. Judgment on the arbitration award may be entered in any court with jurisdiction.
19.1 Class action waiver
YOU AND AIMEE SAYS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
19.2 30-day opt-out
You may opt out of this arbitration agreement (including the class action waiver) by emailing support@aimeesays.com within 30 days of the date you first accept these Terms. The email must include your account email address and a statement that you wish to opt out. Opting out will not affect any other provision of these Terms.
20. Governing law and venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. To the extent any dispute is not subject to arbitration, exclusive jurisdiction and venue lie in the state and federal courts located in Denver, Colorado.
21. Termination by you
You may cancel a paid subscription at any time in Settings. Cancellation takes effect at the end of the current billing period, or you may choose to cancel effective immediately, which forfeits the remainder of the paid period. If you take no further action, your account converts to a free account. At any time, you can choose to wipe your data while keeping your account, or wipe your data while also deleting your account. See Section 5 and the Data Deletion Policy.
22. Termination by us
We may suspend or terminate accounts that violate these Terms (including the Acceptable Use Policy) or applicable law. Where practicable, we will give you notice; we may decline to give notice when the violation involves imminent harm or when notice would be unlawful or would impair an investigation.
23. Data export before deletion
You can export much of your data yourself in the app: Events, chats and documents in bulk, and Binders individually. We encourage you to do this before deleting anything. For a complete copy - or for data not available through the in-product tools - email support@aimeesays.com and we will provide it in a commonly used electronic format.
24. Inactive free accounts
A free account inactive for 365 consecutive days (no account activity, chat sessions, document uploads, Events created, or Binders created) will be deleted after 14 days of advance email notice.
25. Teams
You may invite another person to share access to your account. Invited team members will see all content the inviting account holder can see; please consider this carefully before inviting anyone. As the inviter, you are responsible for whom you invite and for activity in your account. A removed team member loses access immediately but may retain any export they had previously downloaded.
26. DMCA
Aimee Says respects the intellectual property rights of others. If you believe content available through the service infringes your copyright, please send a notice that complies with 17 U.S.C. § 512(c)(3) to our designated agent: Anne Wintemute, anne@aimeesays.com.
27. Mobile application addendum
If you access Aimee Says through a mobile application: (a) the applicable App Store terms also apply; (b) an in-app PIN or biometric lock is available where the device supports it.
28. Changes to these Terms
We may update these Terms. Material changes will be highlighted on the site and emailed to registered users. The change is effective on the date specified.
29. Severability and waiver
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be replaced with an enforceable one that most closely matches the original intent. A failure to enforce any provision is not a waiver of it.

Our data retention practices are tailored to respect user privacy while ensuring the efficient delivery of our Services:
- For Non-Login Services: We adhere to a minimal data retention approach. Data collected during sessions without user login is retained only for the duration of the browser session. Following user-initiated deletion or account termination, Aimee Says Inc. will remove the relevant data from our active databases. However, it's important to note that complete eradication of all records from our servers may not be technologically feasible, and some data may remain in our backup systems until it is purged in regular maintenance cycles.
- Compliance and Legal Obligations: In addition to the above, we retain personal information as necessary to fulfill legal obligations, resolve disputes, and enforce our agreements. The retention period extends for as long as your account is active or as required to provide you with our Services.
This integrated approach to data security and retention is crafted to balance the need for operational efficiency with our commitment to user privacy and data minimization, adhering to applicable legal and regulatory requirements
